Betting tax South Africa is easy to misunderstand because several different taxes sit behind one bet. For most people who occasionally bet with a licensed South African bookmaker, a win is generally not taxable income to declare to SARS. But a bookmaker may deduct a provincial betting tax or levy from a winning payout, depending on the bet and its licence. Regular betting that amounts to an income-producing activity can also be taxable. The key is to separate tax on your income, a deduction from a payout, and tax paid by the operator.

Betting tax South Africa: who pays what?

Charge Who is responsible? What a bettor may see
Personal income tax The bettor, if betting receipts are taxable income Usually no SARS tax on an occasional lawful local win; taxable betting activity is assessed with other income
Provincial betting tax or levy The bettor or bookmaker, depending on provincial rules A deduction from some winning bets, or a cost the bookmaker pays or absorbs
VAT on betting transactions The registered operator accounts to SARS Generally reflected in the economics of the bet, not a separate income tax bill for a casual winner
Proposed national online gambling tax No one yet A 20% tax on operator gross gambling revenue has been proposed, but is not current law

These charges have different tax bases. A provincial percentage on a winning bet is not a percentage of your annual income, while a percentage of an operator’s gross gambling revenue is not a tax on each customer’s withdrawal. SARS explains that provincial law can make either the punter or bookmaker liable for betting tax. As at September 2026, its Budget FAQ says the proposed national online gambling tax has no start date.

Are sports betting winnings taxable by SARS?

An occasional win from lawful local betting

A once-off windfall from gambling authorised under South African law is not treated as taxable income, according to National Treasury’s discussion of the current tax position. This is the usual starting point for a recreational bettor. A large payout does not automatically become income merely because it is large, and depositing it into a bank account does not itself change its character.

SARS also excludes capital gains from lawful South African gambling by individuals in the ordinary case. That matters because “not income tax” does not automatically mean “capital gains tax instead”. The rules look at the nature of the activity and the origin of the win. A South African sports bet through a licensed bookmaker should be considered separately from offshore or illegal gambling. Tax on later earnings is separate. If you put a payout into a savings account, the interest may be taxable even though the original occasional win was not. SARS lists investment income separately.

When regular betting becomes taxable income

Treasury says people who generate frequent income from gambling must declare it as taxable income. There is no universal number of bets or rand threshold that turns a hobby into a trade. The full pattern matters: how regularly you bet, whether you approach it systematically, and whether you rely on it to produce income. A winning weekend is different from running an organised betting operation throughout the tax year.

If the activity is taxable, SARS considers the taxable result under ordinary personal income tax rules, alongside your other income. It is not a flat “winnings tax” on every successful slip. SARS lists profit and loss codes for gambling on its tax return guidance, and its personal income tax page includes business or trade profits among amounts that may form taxable income. If you are unsure where your activity falls, obtain advice from a registered tax practitioner before filing.

The capital gains exception has limits

SARS’s exclusion for gambling gains is narrower than “all winnings everywhere are tax free”. Its capital gains tax guide says the exclusion does not extend to gains from foreign gambling, illegal gambling in South Africa, or gains made by companies, close corporations or trusts. That does not mean every such receipt has the same tax treatment; its facts and legal status must be assessed. The National Gambling Board says online betting is legal with a licensed South African bookmaker and warns against using international gambling companies from within South Africa.

Can tax be taken from a winning payout?

Yes. This is the part many simple answers miss. Under some provincial laws, a winning punter owes a betting tax and the bookmaker deducts it before paying the balance. Elsewhere the bookmaker is liable and pays the tax itself. SARS describes both arrangements. Neither arrangement is the same as SARS assessing your personal income tax.

The Western Cape Act directs bookmakers to collect tax and a levy on winning bets. The Board’s regulations set each at 3%. Actual customer deductions also depend on the product and how the licensed operator applies its terms. For example, SuperSportBet’s terms, updated July 2026, say it retains the combined 6% from winning horse racing bets and pays it over for the customer. The terms specify horse racing only; they do not establish a nationwide 6% deduction on every sports bet.

A simple payout example

Suppose a R100 winning bet has a R300 gross return, including the original R100 stake. The betting profit is R200. If the applicable rules require a 6% deduction on that profit, the deduction is R12 and the customer receives R288. That is an illustration of a provincial deduction, not a prediction of any bet or a universal rate. SARS’s worked VAT example likewise separates the stake, gross return and provincial amount collected from a punter.

Check the bet slip’s gross return, tax or levy deduction, and net payout. If a deduction is unclear, ask the bookmaker which provincial rule applies and whether its displayed return includes tax. The province of the operator’s licence and the type of bet are more useful than a general claim that “South African winnings are tax free”.

What is the gambling tax rate?

There is no single gambling tax rate for everyone. Provincial taxes differ by province, betting product and tax base. National Treasury’s 2025 paper gives examples: Gauteng taxes bookmakers’ gross betting revenue from relevant betting, while the Western Cape framework includes percentages on winning bets. A figure quoted for a bookmaker’s revenue should never be applied directly to your payout.

Gross gambling revenue broadly means stakes taken minus winnings paid over a period. For example, if an operator takes R1 million in bets and pays R900,000 in winnings, its gross gambling revenue is R100,000 before other costs. A 20% tax on that base, if enacted as proposed, would concern R20,000 of operator revenue in this simplified example. It would not mean 20% was withheld from every punter’s win. This is a tax-base illustration; it is not the current national tax. SARS says the 20% proposal remains under consultation.

VAT is another separate layer. SARS explains that a bookmaker accounts for VAT on bets and can deduct input tax related to winnings paid. As an ordinary customer, you do not calculate VAT on a successful bet for your personal income tax return.

What should you keep for SARS and withdrawals?

Save bet confirmations or slips, account statements showing stakes and settled returns, the operator’s tax deductions, and matching bank records. This lets you explain a large credit as a betting payout and, if necessary, establish whether betting was casual or an income-producing activity. SARS’s record-keeping guidance generally requires relevant records to be retained for five years, with longer retention possible during an unresolved audit or dispute.

A bookmaker may also verify your identity or ask questions about funds before allowing a withdrawal. That is a compliance check, not evidence that SARS has charged income tax. The Financial Intelligence Centre’s gambling-sector assessment discusses customer identification and the risks around online deposits and payouts.

Can you deduct losing bets?

For a recreational bettor, losing bets are personal spending, not a deduction against salary or an occasional win. If betting is genuinely a taxable trade, costs and losses require proper records and tax analysis. SARS lists gambling and betting among activities to which the ring-fencing rules can apply. Those rules can prevent an assessed loss from reducing unrelated income such as salary. Do not claim all your stakes as a deduction simply because you have one profitable month or file a tax return.

Common questions about winnings tax South Africa

Is there 15% SARS tax on a win above R25,000?

No general 15% withholding tax on such winnings is in force. The 2011 Budget proposed that measure; the 2012 Budget replaced it with a proposal based on gambling revenue. The R25,000 figure is not a current threshold that makes recreational winnings taxable. A provincial deduction on a particular winning bet is a different issue.

Does a six-figure win have to go on my tax return?

The amount alone does not decide. A casual, lawful local win and taxable betting income have different treatment. Keep the bet and payment records. If betting is a regular source of income, declare the taxable result correctly; if you have an unusual offshore or business arrangement, seek individual tax advice.

Can I claim back a provincial deduction from SARS?

A provincial betting tax shown on a payout is not PAYE or an advance payment of your personal income tax. Do not treat it as a SARS refund simply because your occasional win is outside income tax. Ask the bookmaker for a transaction breakdown if you believe the deduction is wrong; complaints about a licensed operator can be taken to its provincial regulator. The National Gambling Board explains the complaint route.

Are lottery and casino winnings treated the same way?

The same broad distinction between an occasional lawful windfall and income-producing activity applies, but the betting product and its charges differ. SARS’s capital gains guide includes local lottery and casino winnings in its explanation of the individual CGT exclusion. Do not assume that a bookmaker’s provincial deduction for a horse racing win also applies to a lottery prize.
